Mary Carpenter, a national of the Philippines, had married Peter Carpenter, a UK national, in 1996. Mr. Carpenter ran a business providing services to advertisers in other EU Member States. Mary Carpenter applied for leave to remain in the UK as the spouse of a UK national, but her application was refused, and a deportation order was issued against her. The judgement was delivered on July 11, 2002 The key issue was whether Mary Carpenter, as the spouse of a UK national providing services across EU Member States, had the right to reside in the UK under EU law, specifically Article 49 EC and the Directive.
